Mass. State Legislature to Reconsider Reuse Legislation in Upcoming Session





The Massachusetts State Legislature opened the 2007-2008 session on January 3rd. Members had until January 12th to file legislation for consideration in the upcoming session. Among the thousands of bills introduced, several are of particular interest to the medtech community, including a reintroduction of legislation to require patient consent if reprocessed single-use devices are to be used in a surgical procedure. State Senator Susan Tucker re-introduced the legislation, which was co-sponsored by Senator Robert Havern and Representatives Michael Rodrigues and James Fagan.

Legislation to ban certain chemicals and substances used in medical devices, including DEHP, was filed again, as were bills to require licensing of medical device and pharmaceutical sales representatives, and to prohibit physicians from “self-referrals:” for diagnostic procedures.

Action on these bills, including hearings and committee consideration, is not expected until the early spring. MassMEDIC will continue to monitor developments related to these and other bills of interest to the medical device community.
