In May, MassMEDIC held a seminar on the implementation of the medical device excise tax that provided baseline information to area medical device manufacturers. Now that the Supreme Court has upheld the Patient Protection & Affordable Care Act, the medical device excise tax  remains in place. With less than a half of a year remaining until the January 2013 implementation date, will your company be prepared?  This seminar updates information on the tax’s implementation since May and offers new insight into how companies can prepare for compliance.

Representatives of KPMG’s tax team will discuss how the new medical device excise tax will affect you from a practical point of view including lessons learned and best practices.  Topics to be covered include:

  • Whether a company is a manufacturer or an importer
  • Retail exemption for certain devices
  • How the tax base is determined, including application of the constructed sales price rules for sales at retail and intercompany sales
  • IRS ruling requests related to constructed sale price
  • Implementing systems for computation of the tax
  • Rules for becoming registered by the IRS for tax free sales relating to sales and purchases of medical devices for use in further manufacture, and sales for export
